Applying for Visa? Why and How?
What is Visa
Visa is official authorization putting inside your passport from the consular officer for you to be able to travel in one country like the USA. If you have a visa inside your passport it means you have achieved the requirements that the particular visa has, The visa allows you to make travel arrangements to the U.S and board a plane to travel. Airlines always check it whether you have the appropriate visa before you are allowed to board. Most travelers going to the United States need a visa and passport. Customs and Border Protection officers at the port of entry will collect your visa number to verify your authorization to enter. Price of visa are different, it defends to the country. Consular Officer can be denied visa application if they see that applicant didn’t achieve all the proof and documents they need. But not all country required Visa.

K-1 visa or fiancé(e) visa is a non-immigrant visa, Visa issued only to the fiancé(e) of a US citizen. If you approved K-1 visa, you are allowed to enter and stay to the United States for up to 90 days, and within 90 days you must marry your US citizen fiancé.

Eligibility for fiancé(e) Visa
You may be eligible to bring your fiancé(e) to the United States on a fiancé(e) visa if you meet the following requirements:
1. You are a Us Citizen
2. You and your fiancé(e) intend to marry one another within 90 days of your fiancé(e)’s admission to the United States on a K-1 non immigrant visa;
3. You and your fiance are both legally free to marry, this means you both are legally able to marry in the United States and any previous marriages have been legally terminated by divorce, death, or annulment )
4. You and your fiancé(e) met each other in person at least once within the 2 years period before you file your petition
After K-1 Visa was approved
When your fiancé(e) visa was approved, it’s time for you to get ready for her plane ticket and get ready your home, clean it and buy something that you think she might like.
Upon entering the US on a K-1 Visa, the visa holder must get married to the original I-129F sponsor within 90 days. If the marriage does not take place within 90 days or the K-1 Visa holder marries someone other than the original US Citizen who petitioned for them, the K-1 Visa holder will be required to leave the United States. Until the marriage takes place, the K-1 visa holder is considered a non-immigrant. A non-immigrant is a foreign national seeking to temporarily enter the United States for a specific purpose. A K-1 Visa holder cannot obtain an extension of the 90-day time limit.
Failure to marry within 90 days
K-1 and K-2 non-immigrant status automatically expires after 90 days and cannot be extended. Generally, your fiancé(e) and his or her children must leave the United States at the end of the 90 days if you do not marry. If they do not depart, they will be in violation of U.S. immigration law. This may result in removal (deportation) and could affect their future eligibility for U.S. immigration benefits.
However, after you marry your fiancé(e) within the 90 day period, you may now file Permanent Residents ( Green Card ) for her and her K-2 child. Generally, your fiancé(e) may not apply for Green card on any other basis besides marriage to you.
Your US visa is just a document making it possible for you to prove eligibility to enter the USA. But it is not a guaranteed entry into the US. That’s why you will have to go through to border patrol at the port of entry before you totally enter the USA. The first land to the USA you must go through immigration and customs, they will check your documents and check your background and ask some question about you and your US citizen fiance after that they will be going to decide if you should be allowed to enter the US. They are also allowed to detain you if needed and they can arrange your return to your country if you didn’t pass all security and safety checking. So before you let your fiance fly to the USA, always remind her what is allowed and not allowed to bring. And she also must answer all the question of immigration officer correctly and no doubt.
Am I Oblige To Do It Right Away
No, You have to be honest with your fiancé(e) or spouse if you can’t afford to apply for a visa right now or need to solve other issues first. And if you can’t apply visa for her within 2 Years you can always visit her again for you to be able to follow the rules of USCIS that both parties need to meet within 2 years. My husband petitions me after more than 3 years of Long Distance Relationship, But he visited me and our daughter once a year. That set up is fine to me, all you need is be honest and understand each other, love can wait, visa can wait and America can wait. But make sure that her waiting is worth it, you made her wait because you are preparing for her coming and you are preparing for her to be able not to regret that she choose to live with you. Make her happy with you, because she will leave her whole life to her country just to be with you.
